    Stark, Anti-Kickback, and Fraud & Abuse

    We advise health care providers and suppliers on compliance with Stark and the Anti-Kickback Statute, including:

    • Advice regarding self-disclosures under the Stark Self-Referral Disclosure Protocol and the OIG’s Provider Self-Disclosure Protocol.
    • Analysis of a variety of arrangements under Stark ownership and compensation exceptions, and Anti-Kickback Statute exceptions and safe harbors. 

    Regulatory Analysis

    We advise health care providers, suppliers, and professionals on a variety of regulatory and compliance issues.  Examples include:

    • Voluntary disclosures of overpayments to the MAC.
    • Compliance with and interpretation of Medicare, Medicaid, Blue Cross, and other payor rules and regulations.
    • Counseling on Medicare rules for provider-based status and “under arrangements”.
    • Billing for services rendered in provider-based and freestanding clinics.
    • Billing for and supervision of services rendered by mid-level providers.
    • Medical record retention questions and policies.
    • Reimbursement issues for SNFs and urgent care centers.

    HIPAA Breaches and Compliance

    We assist Covered Entities and Business Associates with HIPAA and HITECH compliance, including:

    • Responding to OCR complaints.
    • Handling HIPAA breaches, including  preparation of required notifications to patients and DHHS.
    • Drafting policies, procedures, and forms required by the HIPAA Privacy and Security rules.
    • Drafting and negotiating Business Associate agreements.
    • Conducting HIPAA compliance audits and training.

    Medicare/Insurance Audit Consulting and Appeals

    We have over 20 years of experience advising and defending health care providers and professionals in Medicare and private payor post-payment audits and overpayment appeals.  We also assist health care providers and professionals, including physical therapists, with appeals of disaffiliation and departicipation determinations by health plans.

    Health Plans

    We have experience representing health plans. Our experience includes:

    • Negotiating Pharmacy Benefit Management, Affiliation, and Vendor Agreements.
    • Drafting and advising on Medicare Advantage, Exchange, and Commercial payment policies.
